In "Behavioral Law and Economics: The Assault on Consent, Will, and Dignity," Mark D. White uses the moral philosophy of Immanuel Kant to examine the intersection of economics, psychology, and law known as "behavioral law and economics." Scholars in this relatively new field claim that, because of various cognitive biases and failures, people often make choices that are not in their own interests. The policy implications of this are that public and private organizations, such as the state and employers, (...) can and should design the presentation of options and default choices in order to "steer" people to the decision they would make, were they able to make choices in the absence of their cognitive biases and failures. Such policies are promoted under the name "libertarian paternalism," because choice is not blocked or co-opted, but simply "nudged." White argues that such manipulation of choice is impossible to conduct in people's true interests, and any other goal pursed by policymakers substitutes their own ends, however benevolent they may be, for people's true ends. Normatively, such manipulation should not be conducted because it fails to respect the dignity and autonomy of persons, what some hold to be the central idea in Kant's ethical system, and which serves to protect the individual from coercion, however subtle, from other persons or the state. Shortages of new therapeutics to treat coronavirus disease (COVID-19) have forced clinicians, public health officials, and health systems to grapple with difficult questions about how to fairly allocate potentially life-saving treatments when there are not enough for all patients in need (1). Shortages have occurred with remdesivir, tocilizumab, monoclonal antibodies, and the oral antiviral Paxlovid (2) -/- Ensuring equitable allocation is especially important in light of the disproportionate burden experienced during the COVID-19 pandemic by disadvantaged groups, including Black, Hispanic/Latino and (...) Indigenous communities, individuals with certain disabilities, and low-income persons. However, many health systems have resorted to first-come, first-served approaches to allocation, which tend to disadvantage individuals with barriers in access to care (3). There is mounting evidence of racial, ethnic, and socioeconomic disparities in access to medications for COVID-19 (4, 5). -/- One potential method to promote equitable allocation is to use a weighted lottery, which is an allocation strategy that gives all eligible patients a chance to receive the scarce treatment while also allowing the assignment of higher or lower chances according to other ethical considerations (6). We sought to assess the feasibility of implementing a weighted lottery to allocate scarce COVID-19 medications in a large U.S. health system and to determine whether the weighted lottery promotes equitable allocation. This article focuses on the anxiety about whether God loves one or not. In the author's nearly 30-year ministry, this pastoral difficulty continues to perplex and afflict. While the presenting problem is what in theological parlance is 'a lack of assurance', a side difficulty is the poor and incorrect doctrine of God often associated with this. A Baylor University Study in 2006 characterises the kind of God that different groups of Americans believe in. While the phrase 'a lack of assurance' (...) is a part of dogmatic parlance, and has fallen out of use, the feeling of not belonging to God can be overwhelming for people. This feeling may be overwhelming. This makes it a pastoral issue. This article suggests a pastoral response to this issue and a proposal for a clarification in the nature and character of God using the therapeutic theology of 19th-century Scottish minister-theologian John McLeod Campbell. The criticism has been made that Kant looks racist, at least in his early work. This, however, is to insist on a literal reading. I explore Kant’s use of irony and satire as he battles to defend his vision. I show the rhetoric of irony in a pivotal text, looking at what happens and why.

Focusing on David B. Riazanov career and his pioneering efforts in producing a complete edition of the works of Marx and Engels, the article explains why Riazanov’s variety of Marxism was unacceptable to the Soviet regime, and why from 1924 Lenin was credited with being an outstanding Marxist theoretician, whereas previously he had been regarded only as a skilled political activist. The concept of Leninism as a new stage of Marxism was put forward by Bukharin and elaborated on by Stalin (...) and Zinoviev. Georg Lukács attempted to show that Lenin’s thought had the internal coherence that Bukharin postulated. In support of Lenin’s theoretical credentials, his ‘Philosophical Notebooks’ began to be published from 1925. However, neither Riazanov nor his associate Abram M. Deborin subscribed to the official doctrine that Leninism was a new and higher stage of Marxism. For this stance they fell victim to Stalin’s repression. (shrink)

Properly speaking, money and law are natural outgrowths of human society, evolving over time via the voluntary cooperation that lies at the heart of the social enterprise. And as gold and the golden rule have for millennia formed the basis, respectively, of society’s money and law, they accordingly constitute the “twin pillars of civilization,” governing the social enterprise such that, in Mises’s words, “the human species has multiplied far beyond the margin of subsistence.” It stands to reason, then, that if (...) money and law are corrupted, the social enterprise will be corrupted as well. And as this is precisely what the state has done, essentially toppling the twin pillars of civilization, it is necessary to understand what the state is, where it came from, and how it has systematically gone about corrupting money and law, and thus the social enterprise as a whole. For only then can money and law be returned to their rightful owners, and only then can the state be put in its proper place. The need for judgment is what brings all superheroes down to Earth, and what ultimately makes them relatable to their fans despite their fantastic abilities. Moral philosophy (or ethics) is the area of philosophy dealing with what we should do, what kind of people (...) we should be, and what kind of lives we should live. Despite his superpowers, Superman still confronts ethical dilemmas and still needs to use judgment to solve them. For him, however, the stakes are usually much higher than those the average person deals with. He is the chieftain of the Panther Tribe, which makes him the spiritual leader of his people as well as the king of Wakanda and its head of state. One key aspect that separates virtue ethics from its rival moral theories, consequentialism and deontology, is its focus on character. Judgment, or what Aristotle called "practical wisdom", is the ability to decide how best to act on one's virtues in (...) a particular situation. When T'Challa believed that agents within the US government were helping to overthrow his own, he and the Dora Milaje drove a truck into a building and abducted a businessman involved in the operation. This chapter talks about three basic schools of ethics—utilitarianism, deontology, and virtue ethics. This discussion will not only help people situate Captain America's ethics within moral philosophy more broadly, but also help people understand the ethical points of view of other people in the Marvel Universe. Political corruption imposes substantial costs on shareholders in the U.S. Yet, we understand little about the basic factors that exacerbate or mitigate the value consequences of political corruption. Using federal corruption convictions data, we find that firm-level economic rents and monitoring mechanisms moderate the negative relation between corruption and firm value. The value consequences of political corruption are exacerbated for firms operating in low-rent product markets and mitigated for firms subject to external monitoring by state governments or monitoring induced by (...) disclosure transparency. Our results should inform managers and policymakers of the tradeoffs imposed on firms operating in politically corrupt districts. (shrink)

This paper explores how whiteness as the transcendental norm shapes the meaning structure of Black-being-in-the-world. If home is a place, a site, a dwelling of acceptance, where one is allowed to feel safe, to relax, to let one’s guard down, then being Black in white supremacist America is anathema to being at home for Black people. Indeed, to be Black is to be a stranger, something “strange,” “scary,” “dangerous,” an “outsider.” To be Black within white America belies what (...) it means to dwell, to reside, to rest. In other words, one’s sense of racialized Black embodiment remains on guard, unsettled, hyperalert. Phenomenologically, there is a profound sense of alienation, where one’s racialized body is ostracized and shunned. On this score, I examine, within the mundane context of an elevator, how the dynamics of intersubjectivity and sociality are strained through the dynamics of the white gaze. The white gaze, among other things, functions to police the meaning of the Black body and attempts to de-subjectify Black embodiment. In this way, the only real perspective is white. Black bodies are deemed devoid of a perspective on the world as there is no subjectivity, no sense of agential meaning making. One might say that Black people, on this view, constitute an essence, a typified mode of being. Unlike the existentialist thesis where existence precedes essence, Black people are locked into an objecthood, a fungible and fixed essence. This racial and racist myth is what, for Schutz, would collapse the importance that he places on intersubjectivity and sociality. Indeed, within this paper, I delineate the threatening, necro-political dimensions of whiteness that I experienced after writing the well-known article “Dear White America.” That experience cemented, for me, and for many other readers, what it means to occupy the residence of whiteness, an abode that can take one’s life in the blink of an eye. The experience of the racialized stranger means walking a tightrope, a precarious situation where one flirts with death, where one’s body is deemed hypersexual, inferior, frightening, and monstrous. Based upon this construction, the white body is deemed the site of virtue, safety, deliverer, protector of all things white and pure. Think here of “the white man’s burden” or the idea of “white manifest destiny.” Stain, blemish, taint, and defilement are indelible markers of the stranger. And based upon the logics of racial purity, one must extinguish the “vermin,” the “criminals,” the “rapists.” While I don’t explore this within the paper, Schutz scholars will immediately recognize the genocidal implications of what would have been at stake for Schutz had he not escaped Adolf Hitler’s anti-Semitic gaze and his Anschluss of Austria. My sense is that Schutz would have understood not just the horrors of white racism but would appreciate the necessity of theorizing the need to rethink home as existentially capacious and intersubjectively vibrant. I conclude this paper by thinking through the concept of “breakdown”, delineating its spatial, phenomenological, and subjectively embodied implications. Breakdown, as I use the term, upends forms of white racialized habituation, creating possible embodied psychic space for what I term un-suturing, which involves undoing the machinations of white safety in the face of alterity, where the stranger invokes wonder and self-critique. In response to the 2011 decadal survey, NASA sought to expand and accelerate omics research, releasing its GeneLab Strategic Plan in 2014. GeneLab is an open science data repository and analysis portal for spaceflight and space-relevant omics data. GeneLab’s output has been outstanding, but its full potential as a way to transform space biology has not yet been achieved. Reintroduction programs in which captive-bred or reared animals are released into natural habitats are considered a key approach for conservation; however, success rates have generally been low. Accounting for factors that enable individual animals to have a greater chance of survival can not only improve overall conservation outcomes but can also impact the welfare of the individual animals involved. One such factor may be individual personality, and personality research is a growing field. This type of research presents animal welfare scientists (...) with the opportunity to develop behavior profiles that may predict how particular individuals cope with challenges. This has direct implications for both in situ and ex situ populations and can bridge the gap between animal welfare and conservation. We designed a project to ascertain the presence of personality traits in Blanding’s turtles (Emydoidea blandingii), a species of special concern in the state of Michigan, and assess potential links between traits and post-release success. As hypothesized, the Blanding’s turtles in this study displayed behavioral responses to modified open field tests indicative of distinct personality traits: exploration, boldness and aggression. Additionally, the personality traits were correlated differently with survival and behavior patterns when the turtles were released into the Shiawassee National Wildlife Refuge. More exploratory turtles had higher survival rates, while neither boldness nor aggression were related to survival. Exploratory turtles were also more likely to travel longer distances after release. The use of muskrat dens was related to increased survival, and both bolder and more exploratory turtles made higher use of this feature. Exploratory and aggressive turtles were found basking outside of water more often, while bold turtles were more likely to be found at the water surface. Both of these basking behaviors may increase the risk of predation and may be reflective of a trade-off between risk and behaviors related to physiological health. Understanding how personality affects behavior and survival post-release can be a critical tool for improving reintroduction success. Zoo animal welfare scientists and practitioners can implement approaches that improve the welfare of individuals within the context of conservation initiatives. (shrink)

The December 2008 White Paper (WP) on “Brain Death” published by the President’s Council on Bioethics (PCBE) reaffirmed its support for the traditional neurological criteria for human death. It spends considerable time explaining and critiquing what it takes to be the most challenging recent argument opposing the neurological criteria formulated by D. Alan Shewmon, a leading critic of the “whole brain death” standard. The purpose of this essay is to evaluate and critique the PCBE’s argument. The essay begins with (...) a brief background on the history of the neurological criteria in the United States and on the preparation of the 2008 WP. After introducing the WP’s contents, the essay sets forth Shewmon’s challenge to the traditional neurological criteria and the PCBE’s reply to Shewmon. This elegant and painstakingly detailed portrait of St. Thomas Aquinas, whose distinctive theme is the unity of his life and work, is an elaboration of the first section of the author's substantial article on Aquinas in the Dictionnaire de spiritualité. The present work consists of the following parts: a foreword; sixteen chapters which narrate and reflect upon the relevant events, including the composition of Aquinas' writings, between his birth in 1224/25 and his canonization on July 18, 1323 and its aftermath; (...) a summary chronology; a catalogue of writings and a bibliography, both established by Gilles Emery; and indexes of Aquinas' writings and of proper names. As this bare enumeration of contents suggests, the work resembles and indeed depends upon James A. Weisheipl's monumental Friar Thomas d'Aquino: His Life, Thought, and Works, which was originally published in 1974 and then reprinted "with addenda and corrigenda" in 1983. He (...) was invited to reflect on the Second Vatican Council, to ask questions to leading curial figures, and peritus theologians, as well as Pope Paul VI. Barth's book Ad Limina Apostolorum: An Appraisal of Vatican II contains his questions and an account from Barth of his visit, along with some other important essays. It is still deeply challenging in its incisiveness, despite its brevity. I have always been struck by Barth's Marian criticisms that are so central to his viewpoint about divine agency and human cooperation. These give us an excellent insight into his ecclesiology. They represent the reasons for much of his questioning of various Roman Catholic positions on all sorts of matters. Eberhard Busch's diaries, while Barth's assistant during this period, form a fascinating complimentary account of the visit. These tell of the not-so-fruitful visit to Augustin Cardinal Bea and the great highpoint (for Barth) of his one-hour audience with Pope Paul VI. Barth was impressed by the Jesuits during his visit, but not so much by the Dominicans. He thought the latter had absorbed too many streams of liberal modernity. The two Dominicans participating in this book turn those tides. Indeed, all the authors could be located within the conserving wings of their ecclesial membership, which makes the volume all the stronger in raising serious unresolved disagreements and noting important common ground. It is testimony to Barth's enduring value that this volume seems so timely. The Barth Centre at Princeton and the Pontifical Faculty of the Dominican House in Washington were the sponsors of this collection.The volume is structured around five of the key documents commented on by Barth, with a Catholic and Reformed voice reflecting on both the particular document and Barth's input (with the exception of Francesca Aran Murphy, who deals with George Lindbeck rather than Barth), thereby simultaneously pushing forward the Catholic–Reformed engagement with the Council and with Barth. There is a preface with a penetrating introduction by Thomas Joseph White, O.P., and an irenic opening chapter by Matthew Levering on biblical renewal at Vatican II. Then follow the twin reflections on the five documents.First (and rightly so) comes the Dogmatic Constitution on Revelation, Dei Verbum. Katherine Sonderegger develops a nuanced reflection on the metaphor of Scripture as mirror of God (found in Dei Verbum), showing [End Page 971] a deep appreciation of currents within Dei Verbum that Barth had not detected, but which are more connective with his concerns and preoccupations. Lewis Ayres rather impishly takes what Barth saw as the main weakness of the text (its chapter 2: "Handing on Divine Revelation") and makes it the greatest strength. Ayers provides a deeply learned and original exploration of the concept of "tradition" as sacramental. In this duet, Barth comes out looking like he may have missed hearing the melodies while too closely studying the score.Then follow two profound essays on Lumen Gentium, the Dogmatic Constitution on the Church. Christoph Schwöbel builds up a strong Protestant case for the necessary visible ecclesial identity of the Church, thus showing a deep convergence without denying differences that remain. White, in a deeply insightful and probing essay, goes to the heart of the ecclesiological difference between Barth and Yves Congar (and some other key Catholics at the time): the relationship between uncreated divine agency and created human agency, especially within the context of the post-apostolic Church. White suggests that, without some stable ecclesial mediations, there can be no proper relationship envisaged between the transcendent causality of God operating in Christ and the created, active cooperative acts with this grace. Nature contact has associations with emotional ill-being and well-being. However, the mechanisms underlying these associations are not fully understood. We hypothesised that increased adaptive and decreased maladaptive emotion regulation strategies would be a pathway linking nature contact to ill-being and well-being. Using data from a survey of 600 U.S.-based adults administered online in 2022, we conducted structural equation modelling to test our hypotheses. We found that (1) frequency of nature contact was significantly associated with lesser emotional ill-being and greater emotional (...) well-being, (2) effective emotion regulation was significantly associated with lesser emotional ill-being and greater emotional well-being, and (3) the associations of higher frequency of nature contact with these benefits were partly explained via emotion regulation. Moreover, we found a nonlinear relationship for the associations of duration of nature contact with some outcomes, with a rise in benefits up to certain amounts of time, and a levelling off after these points. These findings support and extend previous work that demonstrates that the associations of nature contact with emotional ill-being and well-being may be partly explained by changes in emotion regulation. In lieu of an abstract, here is a brief excerpt of the content:390 HUME'S DIALOGUES AND THE COMEDY OF RELIGION Laughter is the key to Hume's Dialogues Concerning Natural Religion. Indeed, I would suggest that if the Dialogues have not made one laugh, and if one has not experienced the sheer delight of Hume's rhetorical excesses and gaiety, then one hasn't really understood this work at all. From this perspective, the usual questions are irrelevant — Is Hume Cleanthes or Philo? (...) Is Philo a mitigated sceptic or a Pyrrhonian? Such debates are sterile and miss the point, for however consistent or inconsistent the characters may be, the actual drama of the text has an intention and a direction all of its own, destroying the religious hypothesis not so much by 'serious' calculated argument as by ridicule and excess. Hume's Dialogues Concerning Natural Religion are the expression of a healthy and cheerful malice which strives at every turn to intensify the sense of the absurdity of religion. Hence their flavour is primarily rhetorical, and it would be a mistake to consider them as merely a collection of paraphraseable proofs directed against the possibility of rational theology. This is not to say, however, that Hume did not take religion seriously; on the contrary, he uses all of the devices of comedy in order to overwhelm it — rather as Nietzsche was to argue: "Not by wrath does one kill but by laughter. ml In this paper, I will consider the rhetorical aspect of Hume's Dialogues to show how the literary mode — the elaboration and contrast of characters, the use of parody and sudden turns in the plot, etc. — enables Hume to make a far more compelling assault on the religious hypothesis than the plain recital of 391 'reasonable' objections would ever achieve. I will focus my discussion on three central themes: First, the professed acceptance of God by all of the participants, and the consequent need for an oblique attack upon religion; second, Hume's comic perspectives on the argument from Design; and third, Hume's development of an 'antinomies of religion,' whereby the various religious arguments are used to undermine each other. 1. The Belief in God No man; no man, at least of common sense, I am persuaded, ever entertained a serious doubt with regard to a truth so certain and self-evident. The question is not concerning the being but the nature of God. Ostensibly, the one thing that is never questioned in the Dialogues, the one thing that all the participants remain agreed upon, is that God exists. Indeed, it seems that however limited the scope of natural theology may turn out to be, the actual being of God can never be in dispute, for in the Dialogues, belief in God is often presented as if it were an unchallengeable 'given' of human experience. Cleanthes, for example, apparently follows Locke in arguing for the reasonableness of theism; and yet, when he is pressed he defends the Design hypothesis in terms of its psychological irresistibility, appealing to a natural sentiment of belief rather than the claim of any argument: Consider, anatomize the eye: Survey its structure and contrivance; and tell me, from your own feeling, if the idea of a contriver does not immediately flow in upon you with a force like that of sensation.... it requires time, reflection and study, to summon up those frivolous, though 392 abstruse, objections, which can support infidelity (D 154). According to Cleanthes, the Design hypothesis is so self-evident that it really does not need any philosophical justification at all. It is simply the articulation of what we all already knew to be true: The comparison of the universe to a machine of human contrivance is so obvious and natural, and is justified by so many instances of order and design in nature, that it must immediately strike all unprejudiced apprehensions, and procure universal approbation (D 216). Demea also denies that religion is based upon argument. He claims that each man is brought to feel the truth of religion within himself through the consciousness of his own complete ignorance and misery. The U.S. Food and Drug Administration's rationale for supporting the development and approval of BiDil for heart failure specifically in black patients was based on under-powered, post hoc subgroup analyses of two relatively old trials , which were further complicated by substantial covariate imbalances between racial groups. Indeed, the only statistically significant difference observed between black and white patients was found without any adjustment for potential confounders in samples that were unlikely to have been adequately randomized. Meanwhile, because the (...) accepted baseline therapy for heart failure has substantially improved since these trials took place, their results cannot be combined with data from the more recent trial amongst black patients alone. There is therefore little scientific evidence to support the approval of BiDil only for use in black patients, and the FDA's rationale fails to consider the ethical consequences of recognizing racial categories as valid markers of innate biological difference, and permitting the development of group-specific therapies that are subject to commercial incentives rather than scientific evidence or therapeutic imperatives. This paper reviews the limitations in the scientific evidence used to support the approval of BiDil only for use in black patients; calls for further analysis of the V-HeFT I and II data which might clarify whether responses to H-I vary by race; and evaluates the consequences of commercial incentives to develop racialized medicines. We recommend that the FDA revise the procedures they use to examine applications for race-based therapies to ensure that these are based on robust scientific claims and do not undermine the aims of the 1992 Revitalization Act. This article assesses Herman Paul's intellectual biography of Hayden White, the most important figure in the philosophy of history of the past half century. Offering a clear overview of White's career and contribution, Paul's account proceeds chronologically from the 1950s to the present, distinguishing the phases of White's career, but convincingly pinpointing an abiding core of concerns around an existentialist and liberationist humanism. In that light, White sought to show the way beyond historiographical realism to more (...) innovative approaches—ideally to serve progressive politics. Paul notes, however, that White failed to connect with most mainstream historians, and Paul's account is not sufficiently probing and critical to explore the gulf. Indeed, following White, Paul is too prone to take White's particular liberationist agenda as the only alternative to a conservative, passive realism—and thereby to gloss over alternative ways of conceiving the postrealist cultural space. Moreover, Paul fails to note White's tendency sometimes to imply that mainstream history claims more than it does, and sometimes to denigrate prejudicially what it in fact does, or could do. Although much of White's challenge could have been especially salutary, he tended toward mischaracterizations that fostered polarization in the historical discipline and reinforced prejudicial understandings of historiography in the wider culture. Paul's overview provides a useful, and in many ways exemplary, introduction to White's legacy, but it is too deferential to provide a convincing overall critical assessment. (shrink)
